During the inspection, the operational handbook was viewed and was missing the following information: (9)Safe sleep policy for infants from birth through 12 months old that is consistent with the rules in subchapter H of this chapter (relating to Basic Requirements for Infants) that relate to sleep requirements and restrictions, including sleep positioning, and crib requirements and restrictions, including mattresses, bedding, blankets, toys, and restrictive devices. (23) Instructions on how a parent may access the: (A) Minimum standards online; (B) Texas Abuse and Neglect Hotline; and (C) HHSC website (28) Information on vaccine-preventable diseases for employees, unless your center is in the home of the permit holder. The policy must address the requirements outlined in ?746.3611 of this chapter (relating to What must a policy for protecting children from vaccine-preventable diseases include?) (29) If your operation maintains and administers unassigned epinephrine auto- injectors to use when a child in care has an emergency anaphylaxis reaction, policies for maintenance, administration, and disposal of unassigned epinephrine auto-injectors that comply with the unassigned epinephrine auto- injector requirements set by the Texas Department of State Health Services, as specified in 25 TAC Chapter 40, Subchapter C (relating to Epinephrine Auto- Injector Policies in Youth Facilities) and in Texas Health and Safety Code ?773.0145.

The playground had one active ant bed.

The lighting was too low during inspection at nap time. Note: this was corrected at inspection when the caregiver turned on a lamp.

1 out of 3 infants not yet on table food is missing a written feeding instructions form.

2 infant bottles were not labeled with the first name and last initial. Several bottles of children no longer enrolled were thrown away.

The Emergency Prepardeness Plan is missing the name and address of the alternate shelter. Note: this was corrected at inspeciton when the director named the alternate re-location shelter.

Several pieces of playground equipment were broken and had sharp, jagged edges. Note: this was corrected at inspection when the director removed the items from the playground,

Operation failed to report how many employees left in 2024 by January 15, 2025.

An employee hired on 11/2023 does not have a preemployment affidavit on file for review by licensing.

The operation has not had parents sign stating that they have received the Parents Rights as required.

When the children were eating lunch , school age children were playing on personal tablet devices, and the prekindergarten age children were watching a movie.

A caregiver wiped a child's runny nose with a babywipe, but did not wash their hands afterwards.

A caregiver hired 11/2023 is missing the following from their personnel file: - Documented hire date - Documentation showing how the employee meets the minimum age and education qualifications - A notarized Licensing Affidavit for Applicants for Employment form - A record of training hours - Proof the employee signed and received operational policies. - Proof of Pre-Service Training. - A copy of a photo identification

The Consumer Product Safety certification posted has not been completed for this year. The form posted is blank. This was corrected during the inspection, when the form was completed.

The smoke detectors in the operation are beeping. The batteries need to be replaced.

Based on the evidence obtained during the DFPS investigation, there is sufficient evidence to support the allegation of neglectful supervision when two children were not supervised properly and had physical contact and problematic sexual misconduct.

Based on the evidence obtained during the DFPS investigation, supervision was not maintained which resulted in child-on-child sexual misconduct. Although the caregiver was in the classroom, she was not able to intervene or have close enough proximity to a child to ensure their safety.

There was an 11 months old infant sleeping with a pillow in a play yard. A photos was taken.

I observed that the documented Emergency Practice drills for Severe Weather, Sheltering, and Lock down were not documented correctly with the type of drill conducted.
