A caregiver did not use good judgement when she tossed a child above her head, and the child fell downward to the ground.

Upon inspection the fire inspection was expired.

On 9/6/23 inspector observed one person present and having unsupervised access to children while conducting contract work. The operation stated they have had contracted work being conducted since August 18th, 2023. The operation failed to submit or wait to receive the results of an initial background check or FBI Fingerprint for contracted person(s).

The director failed to operate in compliance minimum standards, and during the course of the investigation, it was found that the rooms were not well ventilated after being painted, infants were placed in the cafeteria with children older than 18 months and no amendment was requested to licensing, the director also did not notify the operation that their playground had been finished for inspection and review, and the director chose to end a safety plan without discussing it with Licensing during the course of the investigation.

Based on the information obtained during the course of the investigation, the operation used poor judgment when they allowed children and staff to be placed in classrooms after being painted. As a result, staff became ill and it is believed that some of the infants became ill while being in care as well. After there had been complaints of the smell the infant children were moved for one day and then placed back into their classrooms.

One child who required a food allergy plan did not have a plan on file.

One out of four staff records was missing 10 hours of annual training for 2022-2023. The trainings missing were Sids, Shaken Baby, Early Brain Development, Communicable Diseases including Immunizations, Food Allergies, Building and Premises Safety, Hazardous Materials including Blood borne Pathogens, and Emergency Preparedness.

The operation had one severe weather drill for 2022 and had no lock down drills documented at the time of inspection.

Multiple classrooms at the facility have chipped paint on the walls accessible to children. One infant room had a broken cabinet, another classroom had broken locks on the bathroom cabinets and cleaners were accessible to the children.

One out of four staff did not have the required 30 hours of annual training for 2020-2021. The following trainings were missing: Child maltreatment, Sids, Shaken baby, and Early brain development, Transportation, Communicable Diseases including Immunizations, Administering Medication, Food Allergies, and Hazardous Materials including Blood Borne Pathogens. One out of four staff did not have the required 24 hours of annual training for 2021-2022. They were missing 2 1/2 hours of annual training. The following trainings were missing: Child maltreatment, Sids, shaken baby, Communicable Diseases including Immunization, Food Allergies, Building and Premises Safety, Hazardous Materials including Blood Borne Pathogens, and Emergency Preparedness Trainings. One out of four staff did not have the required 24 hours of training and were still missing 6 1/2 hours of training for 2020-2021. The staff member was missing Communicable Diseases including Immunizations, Administering Medication, Food Allergies, Building and Premises Safety, Hazardous Materials including Blood Borne Pathogens, and Emergency Preparedness Trainings One out of four staff was missing Communicable Diseases including Immunizations, Administering Medication, and Hazardous Materials including Blood Borne Pathogens. This is a re-cite.

The operation did not have documentation of fire drills, severe weather, or lock down drills. There was also no monthly documentation for smoke alarms, fire extinguishers, or carbon monoxide detectors.

One child who has a documented food allergy did not have a food allergy plan on file.

The operation did not have current documentation of daily buildings and grounds checklist. The last written documentation was from 2019.

One out of four staff did not have the required 30 hours of annual training for 2020-2021. The following trainings were missing: child maltreatment, sids, shaken baby, and early brain development, transportation, and all trainings in standard 746.1311(e). One out of four staff did not have the required 24 hours of annual training for 2021-2022. They were missing 2 1/2 hours of annual training. The following trainings were missing: child maltreatment, sids, shaken baby, and early brain development, and all trainings in section 746.1309 (e) with the exception of medication which was found in the file. One out of four staff did not have the required 24 hours of training and were still missing 11 1/2 hours of training for 2020-2021. The staff member was missing trainings in section 746.1309 (e). One out of four staff was missing trainings from standard 746.1309 (e).

Based on the information provided during the course of the investigation, one staff used inappropriate discipline with a child in care. Staff pulled a child's arm while in care. Staff was also observed pulling on a child's shirt causing the child to fall to the ground.

Based on the information provided during the course of the investigation, one staff member used poor judgment while caring for children. Staff was seen on video by taking away toys from a child and tossing them across the table. The caregiver also used poor judgment when the child was upset and the caregiver did not comfort the child.

One out of the ten employee records evaluated, lacked 2.5 hours of annual training.

Based on the information gathered, the incident/illness report form was not shared with the parents within 48 hours of when the incident occurred.

Based on the information gathered, the operation failed to use good judgment, when two employees incorrectly assessed a child's forearm, by shaking and manipulating the arm to determine an injury.
